The Phases of Rulemaking
 
Phase 1 - Rule Drafting
The Department:
  • Files a Notice of Rulemaking Docket Opening with the Secretary of State
  • Meets internally to determine Department policy
  • Meets with interested persons, persons regulated by the rules, persons not regulated but affected by the rules, and other agencies
  • May form a rules committee or work group to review draft rules
  • Drafts rule language and economic impact statement (EIS)
      
Phase 2 - Rule Process
The Department:
  • Files a Notice of Proposed Rulemaking with the Secretary of State who publishes the Notice of Proposed Rulemaking in the Arizona Administrative Register (AAR)
  • Holds oral proceedings no sooner than 30 days after publication of the Notice of Proposed Rulemaking in the AAR
  • Receives public comments (written or oral), makes changes to the proposed rules, and finalizes the EIS
  • Submits a Notice of Final Rulemaking to the Governor's Regulatory Review Council for approval
      
The Governor's Regulatory Review Council:
  • Holds regularly scheduled public meetings to review final rulemakings submitted to the Council 
  • Submits the approved Notice of Final Rulemaking to the Secretary of State for publication in the AAR
      
The rules become effective 60 days after submission of the Notice of Final Rulemaking to the Secretary of State, unless otherwise stated.

The Secretary of State publishes the rules in the Arizona Administrative Code (A.A.C.).
